The Alaska Legislature has now passed a bill to modify crime law created by Senate Bill 91. But the measure, which received final approval from the Senate Friday, may be unconstitutional.
After the House passed its version of the measure Monday, the Dept. of Law says it discovered a flaw that could make it unconstitutional.
Already, the American Civil Liberties Union (ACLU) is threatening a lawsuit over the provision, which involves sentencing of convicted felons. As it stands, the measure doesn't provide the kind of tiered punishment required for serious and less serious crimes.
